DESCRIPTION
The certificate of habitability is an administrative document that certifies that a home meets the minimum living conditions provided for in current regulations and is suitable for use as a residence for people, without prejudice to the development of other authorized activities.
It is mandatory for:
Rent and sell a home
Contract water, gas and electricity services to the corresponding supply companies
There are two types of certificates of habitability:
First occupation: for new homes or those resulting from major refurbishment
Second occupancy: for used or pre-existing homes.
The expiration of the certificates of habitability is as follows:
First occupation in the case of new homes: 25 years.
First job for rehabilitation: 15 years.
Second occupation: 15 years.
Once these deadlines have elapsed, they must be processed again.
WHO CAN ASK FOR IT?
In all cases:
The person who owns the home.
Representative of the duly authorized owner.
For duplicate certificates:
The person who owns the home.
The person renting the home.
Representative of the duly authorized owner or tenant.
